This was the apparent result of a jury verdict last August in which there were charges of attorney misconduct, juror misconduct and trial errors before the ink was dry on the decision.

The U.S. International Trade Commission has taken interest in a recent case between Apple and Samsung, and no, it’s not the billion-dollar ruling from this summer. The ITC wants to make sure that Apple did not infringe upon Samsung’s patents while making the iPod touch, iPhone, and iPad.

The company said that it is likely to sue Apple over technologies used in the iPhone 5. In court filings, Samsung revealed that it will extend existing complaints and allegations of eight separate patent infringements to Apple's latest phone. The trial is not expected to start until March 2014.

In an article posted by the BBC, Samsung was quoted saying, "We have always preferred to compete in the marketplace with our innovative products, rather than in courtrooms. However, Apple continues to take aggressive legal measures that will limit market competition. Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights."

There is also more news that Apple's iMessage violates up to six Google patents, which Google acquired via the purchase of Motorola. An investigation by the US International Trade Commission is currently underway.

Samsung is reportedly preparing more patent infringement claims against Apple.

We knew Samsung was going to go after Apple the first chance they got for the iPhone5. They said they would go after them for LTE just as soon as the device was announced. That is exactly what they are doing. Both Samsung and HTC are pulling the Ace out from their sleeves and going for the royal flush.

David Lawee, Vice President for Google’s Corporate Development, offered up a few great statements regarding the recent loss that Samsung took in the Apple vs Samsung trial. He admits that Google never was very aggressive at filing patents on many things because they didn’t think it was needed. Specifically pointing out that they didn’t believe ’rounder corners’ could be patented. As well all know, Apple proved that wrong recently.

Samsung had a bit of a rough month in August after going up against Apple in court over alleged patent infringement. While they ended up being ordered to pay a little over $1 Billion to the tech giant, at least they did get some good news in regards to the success of the Galaxy S III. In just 100 days, the Galaxy S III sold over 20 Million units worldwide.

A new report suggests Apple may have a hard time invalidating HTC’s data transmission patents, potentially leading to an import ban on select iOS devices. The Taiwanese manufacturer recently accused Apple of infringing on two of its IPs related to wireless networking. Furthermore, the company reiterated that the patents in question “are critical” to the use of 4G LTE. HTC acquired the patents in April 2011 for $75 million from ADC Telecommunications Inc.

Although Samsung is still in the process of hiding in the shadows of the consumer technology industry in an attempt to lick their wounds that are a result of their rather large defeat against Apple in California, they have managed to present their case in a Japanese court and notch up what can only be classed as an extremely small victory over the Cupertino-based iPhone giants. Although the case is in no way as large as the recent happenings that have been going on in San Jose recently, a victory is still a victory and Samsung will walk away from this one with their heads held a little higher.

The case itself was centered around Patent No. 4,204,977, which refers to an Apple held technology for synchronizing music and video data in devices to servers. In the immediate aftermath of their crushing defeat to Apple last week, a Samsung press release stated that the company wouldn’t rest until their case and points had been heard around the world in the hope that they could draw some attention to what they class as "blatant abuse of patent law".

Although the previous case and this most recent contesting of Apple’s claims are entirely different events, it should give the Korean company some comfort in the fact that a number of their devices have been deemed to not copy some Apple features. The overseeing judge of the trial, Tamotsu Shoji, ruled that the Galaxy Tab amongst other devices were not in breach of the utility patent that basically covers transferring data between two different devices. As part of the outcome, Judge Shoji has ruled that Apple will have to front up and cover the legal feels of the trial, something I’m pretty sure they can cover with a portion of the $1.05 billion they are owed by Samsung.

The origins of this particular case in Japan can be traced back to last year when Apple attempted to claim over 100 million Yuan from Samsung for a number of devices, including the Galaxy S II and the Galaxy Tab. Regardless of this little minor set-back for Apple, the company will still be presenting their legal team at the December 6th meeting in California in an attempt to get a permanent ban on the sale of eight Samsung devices that have been found to infringe on their held patents.

literally!. You know how Apple sued Samsung for mercilessly copying the iPhone in numerous devices and won the lawsuit by taking $1.05 billion from Samsung’s pockets? Everybody knew the war was far from over and now we have proof. Samsung has confirmed that it plans to sue Apple if the upcoming sixth-generation iPhone has 4G LTE functionality built in.

I’m not sure I can say that I’m shocked at 'Samsung vs Apple's verdict, but I can say I’m thoroughly outraged. Anyone reading this knows I’m on the Android side of the fence, but that has nothing to do with it. I’ve already stated that if things were reversed, I wouldn’t want to see Samsung win either. I know readers probably won’t believe that, but it’s true. Yes, I want Android to always be the leader, but never at the expense of innovation.

As you know, Samsung and Apple have been in a very heated battle regarding who copied whose patents, and assuming no settlement is reached, a final verdict will be made in the next few days. Yesterday, in a turn of events, Samsung was able to score a victory as Judge Koh made a surprising reversal to the prior ruling by Magistrate Judge Paul S. Grewal. Judge Grewal had originally decreed that the jury would be told Samsung had failed to retain evidence as part of the jury instructions.

Apple maybe riding on a wave of unprecedented pre-release interest in their next-generation iPhone that is due to be announced next month, but it isn’t all sunshine and happiness for the Cupertino-based technology giants. Although the next few weeks represents an extremely exciting time for Apple and all those who are involved in the iPhone project, legal representatives of the company are still locked in an ongoing patent battle with Samsung with proceedings set to come to an end at some point next week.

Although Apple has presented evidence that points out three different loss of sales scenarios that is seeing them claim up to $2.8 billion in damages from Samsung, there is by no means any guarantee that the judge or jury will see the situation from their point of view, meaning it is in no way the foregone conclusion that some people seem to think it is. As if Tim Cook and his team didn’t have enough to worry about, Google-owned Motorola Mobility have let it be known that they are less than happy with some of Apple’s products and want to contest their validity in court.


To show that they are serious about their patent infringement claims, Motorola Mobility has filed a new complaint with the United States International Trade Commission. This isn’t the first time Motorola has attempted to have some shackles slapped onto Apple’s extremely popular iOS devices with an earlier attempt this year being thrown out before they even got started. Something has obviously changed in the Mobility ranks considering they have a new found confidence in their case that they claim sees no less than seven of its owned patents being infringed upon.

We don’t have any official word from Apple about this latest attempt to drag them through the courts, but Motorola is claiming that attempted talks with Apple to work out some kind of license agreement for their innovations have failed, leaving them with no other option but to pursue this legal avenue. The case focuses on Apple’s major mobile devices like the iPod touch, iPad and iPhone as well as their range of Macs will reportedly be brought into question whether or not technologies like Siri and location-based reminders are entirely Apple’s own work.


Not a great deal more information is available at present and we will know more as it progresses and we actually see some kind of retort from the fruit company, but with Motorola attempting to get some kind of import ban on the iPhone, it is certainly a headache that Apple could do without.

After presenting all the evidence in its possession, Apple rested its case in the patent dispute case against Samsung today. In the case Apple brought against the South Korean consumer electronics giant, the burden of proof fell on Apple to prove that Samsung knowingly copied the design of the iPhone when designing its Galaxy line of devices. As expected, Samsung argued that Apple failed to meet its legal obligation and that the case should be dropped.

Judge Lucy Koh was having none of it, though she did concede some of Samsung’s points in the objection, deciding to throw out a few Samsung devices from the laundry list of affected devices. The Samsung Galaxy Ace, as well as the international versions of the Galaxy S and Galaxy S II were dismissed from the case. The move can be viewed as a hollow victory for Samsung, as the majority of the damages being sought in the case pertain to the U.S. variants of these devices. Further, Judge Koh’s dismissal does not prevent Apple from going after Samsung for the dismissed devices in pending cases with Samsung USA’s parent company.

Now that Apple’s case is finished, Samsung’s task is clear; the company must prove to the jury that it is not infringing on Apple’s patents. In addition, Samsung will try to persuade the court that Apple shouldn’t have been granted the patents in the first place, either because the technology itself was not patentable, or more likely, that Apple’s inventions weren’t actually new. Samsung will base at least part of its argument on a service called LaunchTile, which was designed to allow one-handed use of a smartphone through zooming, and was created in the summer of 2004.

Once the claims from Apple have been properly defended, Samsung will turn its focus to its counter suit against Apple. Samsung is arguing that Apple violated some of Samsung’s own patents, and the company will attempt to convince the jury to rule in its favor.

The case should be winding down this week, giving the jury time to deliberate and decide whether or not Apple should be awarded the $2.5 to $2.75 million in damages it is seeking.

Most of you definitely know that it’s been nearly two weeks since the Apple vs Samsung trial started but despite all the evidences and leaked documents so far, it is still boiling. Each leaked document has revealed some amazing truths and facts about both companies. Well, a latest report regarding the case is a bit shocking and simply put, Stupid. Apple also regards Samsung as a “Key Partner” in the slides and states that “it is disappointed that Samsung has been infringing Apple’s patents without proper license”.

We already know that way back in 2010 Apple tried to sell its licenses to Samsung for patents they have been infringing upon. We also know that Apple demanded more than 2 billions in damages from Samsung. However, today’s leaked documents show the exact number figures per license – $30 per smartphone and $40 per tablet. Apple thinks that this is a great offer and Samsung should respond in favorably. There’s more to it, Apple wants $30 on each smartphone by Samsung including Android, Windows, Symbian and Bada, according to them all these phones are infringing on one or more of their patents.

I couldn’t help but notice that these prices are a bit extravagant and understand why there was no progress back in 2010 when Apple wanted to negotiate with the Korean Giant.
